Avenue 81 (which does business as Leadpages) has been hit with a proposed class action that claims the marketing company sent illegal text message advertisements to consumers’ cell phones without their prior consent.

The plaintiff says he received several marketing messages from the defendant that contained advertisements and a link to the company’s website.
“At no point did Plaintiff solicit Defendant’s services, nor did Plaintiff have any relationship with Defendant,” the case alleges, adding that the company was required under the Telephone Consumer Protection Act to obtain the plaintiff’s consent before sending him automated texts.
The lawsuit insists the messages were “excessive, inconvenient, harassing,” and “placed in complete disregard” of the plaintiff’s privacy.
