A proposed class action filed by a blind individual against Le Bernardin, Inc. claims the restaurant's website unlawfully contains accessibility barriers.
A proposed class action filed by a blind individual against Le Bernardin, Inc. claims the restaurant’s website unlawfully contains accessibility barriers that “make it difficult if not impossible” for blind customers to use the website. According to the plaintiff, Le Bernardin has violated the Americans with Disabilities Act (ADA). From the lawsuit:
“Despite readily available accessible technology, such as the technology in use at other heavily trafficked retail websites, which makes use of alternative text, accessible forms, descriptive links, resizable text and limits the usage of tables and JavaScript, [the defendant has chosen to rely on an exclusively visual interface, including a navigation bar that is inaccessible. Le Bernardin’s sighted customers can independently browse and make a purchase or reservation online without the assistance of others. However, blind people must rely on others to assist them in accessing and making a purchase or reservation on Lebernardin.com.”
The plaintiff claims she attempted to buy a cookbook off the defendant’s website but was unable to because the site is allegedly incompatible with screen reader software.
