Zwicker & Associates, P.C. is on the receiving end of a proposed class action lawsuit accusing it of violating several provisions of the Fair Debt Collection Practices Act by sending a consumer what the suit deems a “deceptive” collection letter. According to the complaint, the defendant’s letter specified the plaintiff’s balance but failed to indicate whether it would increase due to interest, late fees, and other fees. The case argues that the defendant neglected its obligation under the FDCPA to communicate the minimum amount the plaintiff must pay and the total amount required to settle the debt at any time in the future.
The suit further claims the defendant falsely implied that an attorney was “meaningfully involved” in the collection of the plaintiff’s debt by including several references to itself as a law firm but failing to disclose that no attorney had reviewed the plaintiff’s case.
