Gomez v. YOU FIT, LLC
Filed: June 1, 2017 ◆§ 1:17-cv-22061-KMW
You Fit, LLC is facing claims that its website – youfit.com – denies equal access of its goods and services to blind people using screen readers.
You Fit, LLC is facing claims that its website – youfit.com – denies equal access of its goods and services to blind people using screen readers. A proposed class action lawsuit has been filed in Florida federal court against You Fit Health Clubs, alleging that its website discriminates against the blind population by failing to remove the following access barriers: lack of alternative text in images and links; lack of labels on forms and headings; and missing document language that aids screen readers in translation of the document. The suit argues that as a result of this missing information, blind individuals are unable to navigate through the defendant’s website and access the goods and services it offers, such as gym locations, memberships, classes, information about events, and various products for sale. The complaint cites alleged violations of the Americans with Disabilities Act of 1990 and seeks injunctive and monetary relief from the defendant’s supposed discrimination.
