Lawsuit Takes Issue with Envelope in Arcadia Recovery Bureau Collection Dispute

A Pennsylvania consumer’s proposed class action lawsuit claims defendant Acadia Recovery Bureau, LLC unlawfully mailed her a collection notice in an envelope on which the company’s name was clearly visible, which “strongly implied” that it is in the collection business. The plaintiff alleges her privacy rights were violated as a result of the defendant’s alleged conduct, as anyone who handled the woman’s mail “would have been informed of the nature of the letter.” The complaint alleges such conduct violates the Fair Debt Collection Practices Act (FDCPA) and constitutes the use of “unfair or unconscionable means” to attempt to collect a debt.
The lawsuit further alleges the communication itself contained language contradictory to that of the FDCPA. The defendant’s alleged prompting of the plaintiff to call the company if she had any questions or felt she did not owe the amount stated “strongly implies that if a consumer disputes the validity of the debt or any portion thereof, the consumer should simply telephone” Acadia Recovery Bureau, the case reads. The lawsuit argues the defendant included this language as a tactic to confuse the plaintiff as to whether to call or submit a written dispute of her obligation.
