Fligman v. Alltran Financial, LP
Filed: December 8, 2017 ◆§ 1:17cv7176
According to a lawsuit, Alltran Financial unlawfully failed to state in a collection notice if the plaintiff's balance may increase due to interest.
A consumer from New York has filed a proposed class action in which she alleges Alltran Financial, LP mailed her a collection notice in which the company failed to state whether her balance may increase due to accruing interest and fees. The lawsuit notes that even though the plaintiff’s debt balance was due to increase per her contract with her original creditor, Alltran Financial still had the responsibility to disclose in the notice that this was the case. According to the complaint, the plaintiff was left uncertain as to whether paying the amount stated in the notice would fully satisfy the debt.
