Jobs and Main Realty Co. and a John Doe defendant are wrapped up in a proposed class action filed over alleged structural violations of the Americans with Disabilities Act.
Jobs and Main Realty Co. LLC is facing a proposed class action lawsuit along with a John Doe defendant the case says does business as Ann Crabtree. The lawsuit says the defendants respectively own and lease a property located in Southampton, New York that is inaccessible to disabled individuals. According to the case, the property, on which an Ann Crabtree retail store is located, doesn’t have an accessible pathway leading to the entrance. Moreover, the change in ground level and lack of maneuvering space near the door bar individuals using wheelchairs or scooters to easily enter the store, the lawsuit continues.
Further, the plaintiff claims the store’s dressing rooms have “unlawful dimensions” to go along with a lack of sufficient floor space and bench seats of a specified size.
The lawsuit argues that the defendants should have completed accessibility modifications by January 26, 1992 but instead continue to deny disabled individuals equal access to their public accommodation.
