Simm Associates, Inc. and Oliphant Financial, LLC are the defendants in a proposed class action through which the plaintiff seeks to represent a group of Nebraska consumers who received collection letters from the defendants that failed to properly identify the name of the current creditor owed payment. The complaint says Simm Associates sent collection notices to proposed class members on behalf of Oliphant Financial. The letters, like the one received by the plaintiff in May 2017, supposedly listed Oliphant Financial as “Our Client” without clearly specifying the entity as the current creditor as required by law.
