Levine v. Amazon.com, Inc.
Filed: September 28, 2017 ◆§ 9:17-cv-81093-WPD
Amazon.com, Inc. is facing another proposed class action alleging it knowingly sold defective solar eclipse glasses before the widely viewed August 21 event.
Amazon.com, Inc. is facing another proposed class action alleging it knowingly sold defective solar eclipse glasses before the widely viewed August 21 event. The case claims some of the glasses Amazon sold on behalf of third-parties “did not meet ISO 122312-2 standards” and posed a risk of irreparable eye damage to anyone who used them to view the solar eclipse. According to the suit, Amazon sent a warning email on August 12, 2017 to purchasers of the allegedly defective glasses informing them that “Amazon has not received confirmation from the supplier of your order that they sourced the item from a recommended manufacturer” and instructing consumers not to use the product. Nevertheless, the complaint argues, a significant number of consumers never received what the suit calls Amazon’s “woefully inadequate email notification” because many of the glasses were sold in multi-packs and distributed to non-purchasers.
The plaintiffs in the case, a married couple from Boca Raton, Florida, claim they purchased and used the eclipse glasses without receiving any warning and began experiencing pain, discomfort, blurry vision, and color perception impairment within 24 hours of the eclipse. They allege that Amazon knew about the possibly defective glasses before its August 12 email and failed to adequately warn consumers of the potential risk associated with use of the product.
