PVK, Inc. has been accused in a proposed class action lawsuit of falsely labeling its Scarpetta brand pasta sauces as containing 'no preservatives' when citric acid is listed as an ingredient.
PVK, Inc. has been accused in a proposed class action lawsuit of falsely labeling its Scarpetta brand pasta sauces as containing “no preservatives” when citric acid is listed as an ingredient. The suit claims citric acid is considered by several reputable sources, including the FDA, to be a preservative, rendering the defendant’s labeling misleading.
“By marketing the Products as having ‘No Preservatives,’” the complaint reads, “Defendant wrongfully capitalizes on and reaps enormous profits from consumers’ strong preference for food products made free of preservatives.”
The lawsuit names the following items, but notes that other products may be affected:
- 19.8 oz Marinara Sauce
- 19.8 oz Arrabbiata Sauce
- 19.8 oz Puttanesca Sauce
- 19.8 oz Tuscan Vodka
- 19.8 oz Cherry Tomato
- 19.8 oz Pink Pesto
