A California consumer has filed a proposed class action lawsuit against Vivint Solar Inc. and Solar Mosaic Inc. claiming the defendants illegally accessed his credit report without a 'permissible purpose.'
A California consumer has filed a proposed class action lawsuit against Vivint Solar Inc. and Solar Mosaic Inc. claiming the defendants illegally accessed his credit report without a “permissible purpose.” The suit alleges that both Vivint and Solar Mosaic requested the plaintiff’s credit report from Trans Union under the guise that the plaintiff had an existing account with them or had requested an extension of credit. The plaintiff argues that he “never conducted any business nor incurred any additional financial obligations” to the defendants. According to the complaint, the defendants procure credit reports for marketing, research, investigation, sale of information, or other “impermissible” purposes, in violation of the Fair Credit Reporting Act. The plaintiff says he privacy was unlawfully invaded and his credit score suffered as a result of the defendants’ alleged misconduct.
