Lawsuit Says Stern & Stern Misled Consumer Regarding Debt Amount, Possible Attorney Involvement

A consumer claims that Stern & Stern, P.C. failed to convey her debt amount and falsely implied that an attorney was involved in its collection efforts.
A New York consumer claims that law firm Stern & Stern, P.C. failed to accurately convey her debt amount and falsely implied that an attorney was involved in its collection efforts.
The suit first takes issue with a December 2017 letter sent to the plaintiff by the defendant on behalf of her creditor, Tax Correction Agency Inc. According to the complaint, the notice stated, in part:
"Please note that the balances stated above may increase over time due to interest, costs or fees."
The suit claims that despite this misleading disclosure, the account was not, in fact, subject to any interest or fees.
In November 2018, the case continues, the defendant sent another collection notice to the plaintiff concerning a different debt owed to the same creditor. The case argues that because the letter did not qualify that the account was not being reviewed by an attorney, the plaintiff was led to believe that an attorney employed by the defendant was actively involved. In actuality, according to the suit, the law firm was acting solely as a debt collector and not in a legal capacity.
