The 21-page suit says in particular that the shelves found in the Hisense fridges at issue suffer from a flaw that causes the plastic framing of the glass shelves to break and/or detach, significantly hampering the overall functionality of the appliance. Per the case, most consumers have encountered the Hisense shelf problem “without warning” and “unexpectedly, once weakening, detachment, or separation occurred.”
Even with proper fridge maintenance and only normal and intended use of the appliance, which reportedly retails for no less than $1,899, the plastic framing of the shelves is simply “too weak to withstand normal use or support loads below weight capacity,” the complaint summarizes.
As the lawsuit tells it, Hisense French door fridge users often opt for temporary remedies to the shelf problem, such as tape or glue to hold the loosened or detached parts together. Others have called upon third parties to service their fridges, or have repaired the appliance themselves at home with the help of online tutorials and replacement parts, the case adds.
The suit accuses defendant Hisense USA Corporation of having misleadingly advertised the fridges as technologically advanced and built to last.
“Plaintiff paid more for the Product than he would have had he known the representations and omissions were false and misleading, or would not have purchased it,” the case claims.
The lawsuit looks to cover all consumers in Florida who bought a Hisense 26.6-cubic-foot French Door Refrigerator with an ice maker (HRF266N6CSE) in the state during the applicable statute of limitations period.
