A New York consumer claims Encore Receivable Management, Inc. broke the law by failing to, in a collection notice, adequately and honestly convey the amount of her debt. In a proposed class action lawsuit filed in New York, the plaintiff argues she received a collection notice from the defendant in November 2016 that failed to expand upon whether the stated balance included finance charges, late fees, or any other additional costs. Similarly, the plaintiff says the defendant also failed to mention whether the balance may increase as a result of the application of these additional fees.
