Matzura v. Doughnut Plant, Inc. et al
Filed: July 9, 2017 ◆§ 1:17-cv-05169
A blind NY man claims in a class action lawsuit that DoughnutPlant.com contains accessibility barriers that violate the Americans with Disabilities Act.
A blind New York consumer claims Doughnut Plant, Inc. and six other entities who operate DoughnutPlant.com should be held responsible for the site’s alleged failure to comply with the Americans with Disabilities Act (ADA). The 28-page lawsuit alleges the defendants’ website is “heavily integrated” with the companies’ physical locations, making it subject to ADA regulations governing places of public accommodation. Further, the plaintiff claims he was unable to find the location and hours of operation of the defendants’ brick-and-mortar locations on the companies’ website and was prevented from visiting the restaurants as a result.
