A proposed class action claims defendants EHT Pharmacy, LLC, and Specialty Care RX Limited Liability Company, which do business together as Curexa, violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited junk fax advertisements. The lawsuit, which was filed in Pennsylvania district court, alleges the defendants sent facsimile advertisements that did not contain mandatory opt-out language to “at least 40 other persons in Pennsylvania” without first receiving prior consent to do so. The plaintiff, New Leaf Recovery Services, claims it had no prior relationship with the defendants before receiving the junk faxes.
