Lawsuit: Samsung Offers Sub-Par Remedies for Recalled Washers

Samsung Electronics America, Inc. is facing another lawsuit that claims it failed to adequately reimburse consumers who bought recalled washing machines.
Samsung Electronics America, Inc. is facing another lawsuit filed in Florida federal court that claims it failed to adequately reimburse consumers who bought washing machines that were recalled due to an inherent defect. According to the complaint, Samsung recalled approximately 2.8 million top-loading washing machines with lids that were prone to detaching during high-spin cycles. The manufacturer allegedly offered the following three remedies for consumers who bought the recalled machines: a repair to reinforce the washing machine lid, a rebate to replace the machine, or a full refund for consumers who bought their machines within 30 days before the recall announcement.
The plaintiff in the suit says she chose the repair option for her daughter’s washing machine, but that the repair did not allow the machine to be used on all settings. Instead, her daughter was allegedly warned not to use the high-spin settings to wash bedding or bulky items. The plaintiff says she then attempted to elect the rebate option, but was denied because she had already chosen the repair. She claims she was never told that the repair would not restore the machine to full use, or that her decision to repair the washer would preclude her from choosing the rebate. As a result, the plaintiff’s daughter, who was expecting twins, was left without a fully operable washing machine and was forced to replace it out of pocket, the suit says.
