Renewable Energy Center, LLC, which does business as American Pro Energy, is facing a proposed class action lawsuit that claims it violated the TCPA.
Renewable Energy Center, LLC, which does business as American Pro Energy, is facing a proposed class action lawsuit that claims it violated the Telephone Consumer Protection Act (TCPA) by using an automated dialing service to contact consumers without their prior consent. The plaintiff says she received a call from the defendant that utilized a pre-recorded voice. When she was transferred to a live representative, she allegedly requested to be removed from the company’s calling list. She claims she was called at least six more times over the next few days. The suit argues that “such calls are a nuisance, an invasion of privacy, and an expense to Plaintiff.” Because the plaintiff had not provided her cellular number to Renewable Energy Center and had “no established business relationship” with the defendant, the automated calls violated the TCPA, according to the suit.
