Preferred Care Partners, Inc. and iCare Health Solutions LLC are facing a proposed class action that claims the defendants violated the terms of their healthcare policies and denied participants the full value of their benefits.
Preferred Care Partners, Inc. and iCare Health Solutions LLC are on the receiving end of a proposed class action that claims the defendants violated the terms of their healthcare policies and denied participants the full value of the benefits they should have received after paying their monthly insurance premiums. According to the complaint, Preferred Care purported to grant plan participants a yearly credit of $200 or $300 toward the purchase of “lenses/frames and contact lenses” provided through the company's contracted partner, iCare. The plaintiff claims, however, that the defendants contradicted the “plain language of the insurance contract” by restricting consumers to the purchase of either lenses and frames or contact lenses, but not both.
Further, the suit argues that the defendants failed to indicate in the policies that the credit can only be applied to one yearly purchase and that “if a member does not use the full amount of the Benefit Limitation in his first claim then the member loses the remaining balance of the credit.”
The suit was originally filed in state court but has since been removed to federal court in the Southern District of Florida.
