Powers Friedman Linn PLL is facing a proposed class action lawsuit filed by an Ohio woman who claims the defendant unlawfully demanded that she pay her creditor’s attorney fees. According to the complaint, the defendant filed a lawsuit on behalf of its client that attempted to collect unpaid rent from the plaintiff. The woman says the amount sought in the lawsuit was $250 higher than her original balance due to added “legal fees.” The suit argues that under Ohio law, the defendant is not permitted to collect from the plaintiff her creditor’s attorney fees and that any demand for unlawful charges violates the Fair Debt Collection Practices Act.
