A West Virginia man has filed a proposed class action lawsuit alleging Portfolio Recovery Associates L.L.C. sent him collection letters attempting to a collect a debt that was beyond the statute of limitations.

A West Virginia man has filed a proposed class action lawsuit alleging Portfolio Recovery Associates L.L.C. sent him collection letters attempting to a collect a debt that was beyond the statute of limitations. The letter offered the plaintiff payment options, but failed to advise that any payment toward the debt would restart the clock, opening him up to future liability and legal action to collect the money supposedly owed. The suit alleges the defendant sent similar letters to other residents of West Virginia seeking to collect time-barred debts in violation of state and federal consumer protection laws.
