Hayes v. National Credit Audit Corporation
Filed: December 1, 2017 ◆§ 3:17cv3262
According to a lawsuit filed in Texas, National Credit Audit Corporation mailed a consumer a notice that failed to include mandatory validation language.
Texas
National Credit Audit Corporation is the defendant in a proposed class action out of Texas in which the plaintiff claims an email she received from the company contained one or more violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims she received an email from the defendant in September 2017 over a debt supposedly owed to “Northwest Crossing Apartments.” According to the lawsuit, the defendant unlawfully failed to include the FDCPA’s mandatory validation notice in this email—the first communication between the plaintiff and defendant—which left the woman unaware that she was entitled to request verification of the debt from National Credit Audit Corporation.
