Monterey Financial Services, Inc. (which does business as Monterey Collections) is facing a proposed class action lawsuit that claims it sent a New Jersey resident a collection letter enclosed in a misleading envelope.

Monterey Financial Services, Inc. (which does business as Monterey Collections) is facing a proposed class action lawsuit that claims it sent a New Jersey resident a collection letter enclosed in a misleading envelope. According to the complaint, the envelope stated, “IMPORTANT TAX INFORMATION ENCLOSED.” The suit argues that the letter did not, in fact, contain important tax information but instead informed the plaintiff that he could use his tax refund to pay off his alleged debt. The complaint claims the defendant falsely purported to be the Internal Revenue Service or another government agency when, according to the Fair Debt Collection Practices Act, the envelope it sent the plaintiff should not have contained any information on it besides an address.
