Midland Credit Management finds itself as the defendant in another debt collection lawsuit, this time filed in Florida.
A proposed class action filed by a Florida consumer claims Midland Credit Management, Inc., working as an agent for Midland Funding, LLC, mailed her a collection notice over a past-due debt that included a misleading statement regarding the potential of her account being reported to a credit bureau. The lawsuit alleges that the defendant’s inclusion of language stating, in pertinent part, “due to the age of this debt, we will not report payment or non-payment of it to a credit bureau” is deceptive and misleading because, even though Midland, by law, was prevented from reporting the plaintiff’s account, it gave the false impression “that there could be no negative consequence” as it relates to the plaintiff’s credit.
“She could then find out days, months, or years later that the defendant or some subsequent debt collector reported said debt and impacted her ability to obtain credit,” the lawsuit posits.
