Dietary supplements Metabolic Nutrition Synedrex and Metabolic Nutrition E.S.P (Energy Stimulant Pre-Workout) are at the center of a proposed fraud class action lawsuit.
Dietary supplements Metabolic Nutrition Synedrex and Metabolic Nutrition E.S.P (Energy Stimulant Pre-Workout) are at the center of a proposed class action filed against the products’ makers, IQ Formulations, LLC and Europa Sports Products, Inc., over alleged unfair and deceptive business practices. At particular issue in the 37-page lawsuit are claims that the defendants misrepresented the nature and quality of the supplements on the products’ labels – and also added a questionable ingredient.
Filed in Florida by consumers from Illinois and New York, the complaint claims the defendants, in an effort to differentiate their products, included an illegal ingredient in the supplements to entice consumers into making a purchase. From the lawsuit (emphasis ours):
“The difference between the products [the defendant] expressly and/or implicitly purported to deliver, and the products actually delivered, is significant. As described below, both Synedrex and E.S.P. contain an unlawful ingredient, MethylPentane Citrate, and for that reason, each product is similarly adulterated for purposes of the United States Food, Drug and Cosmetic Act … and similar state laws, and is therefore unsafe for human consumption, and cannot be lawfully sold to consumers.”
