Intermex Wire Transfer, LLC is facing a proposed class action lawsuit filed by a Florida man who claims the defendant violated the Telephone Consumer Protection Act (TCPA) by sending him text messages without first obtaining consent to do so. The defendant, the complaint explains, allows users to sign up to receive text message notifications for “each step” of their wire transfer process and uses predictive autodialing technology to send the messages. The plaintiff argues that despite never having signed up for Intermex's services, having no business relationship with the company, and never providing consent for receiving texts, the defendant delivered “a series of text messages” to his cell phone sometime in 2017. According to the suit, the messages, which were written in Spanish, resulted in “aggravation, annoyance, and nuisance and invasions of privacy.”
