Lawsuit: Illinois Physician Seeks Unpaid Interest on Treatment for Workers Comp. Patients

An Illinois physician has filed a proposed class action lawsuit against 45 insurance companies, administrators, and claims adjusting companies alleging that they unlawfully failed to pay interest on medical bills for patients insured under the Illinois Workers’ Compensation Act. The suit is brought on behalf of a proposed class of Illinois physicians who rendered medical services to employees covered under the Illinois Workers’ Compensation Act anytime since July 20, 2005 and did not receive their rightful interest payments from the defendants. According to the complaint, the companies attempted to avoid paying mandated interest in the following ways:

• providing “false or misleading” information on Explanation of Benefits (EOB) forms to conceal the identity of the patient’s insurance carrier;
• providing false information on EOB forms concerning the date the defendants received doctors’ requests for reimbursement to give the appearance that their payments were timely; and
• failing to provide EOB forms for claims that were “concluded by settlement or decision of an arbitrator or the Workers’ Compensation Commission.”

 

As a result, the suit argues that the defendants “systematically and routinely” denied proposed class members their rightful interest payments, subjecting them to financial harm and impeding them from being able to maintain their practices.
