Huck Finn’s Playland, LLC is on the receiving end of a proposed class action lawsuit that claims it violated the Americans with Disabilities Act by failing to make its website – www.Hucksplayland.com – compatible with the screen-reading technology used by visually impaired internet users. The plaintiff, a blind New York resident, alleges he attempted to access the site to purchase tickets for the defendant’s amusement park – Huck Finn’s Playland in Albany, New York – but was unable to complete the transaction. In addition to ticket purchases, the site allegedly allows users to access information about the park’s rides and attractions, location and hours, group rates, events, and employment opportunities.
The plaintiff argues that he and proposed class members were unlawfully denied “free and equal access” to the defendant’s goods and services offered through its website due to the site’s supposed lack of alternative text, inaccessible forms, lack of adequate prompting and labeling, lack of navigation links, and denial of keyboard access. The complaint claims the defendant “has failed to take any prompt and equitable steps to remedy its discriminatory conduct” and demands that the website be modified.
