McCarthy, Burgess & Wolff, Inc. and HSN, Inc. (which does business as Home Shopping Network) are on the receiving end of a proposed class action lawsuit alleging violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff in the case alleges that she had agreed to two modified payment plans for her HSN credit card, but claims the defendants sent her a letter attempting to collect on the accounts while her payments were still current.
“By sending Plaintiff a debt collection letter before the terms of her payment agreement had terminated,” the complaint summarizes, “McCarthy unconscionably sought to engage in deceptive and harassing conduct against Plaintiff in order to accelerate the repayment of the alleged debt.”
