Heritage Financial Recovery Services, a Division of N.N.J.C.A.B., Inc. is facing allegations that it failed in its communications with consumers to identify itself as a debt collector attempting to collect a debt.

Heritage Financial Recovery Services, a Division of N.N.J.C.A.B., Inc. has been named as the defendant in a proposed class action filed out of New York federal court that alleges it failed in its communications with consumers to identify itself as a debt collector attempting to collect a debt. The plaintiff says he received a message from the defendant that stated the following:
“Name is Jeff calling from Heritage Financial, callback number is 8003253440.”
The suit argues that the Fair Debt Collection Practices Act (FDCPA) requires debt collectors to clearly specify their identity and purpose when contacting consumers, which the defendant allegedly failed to do. From the complaint:
“A message left by a debt collector which does not state that it pertains to collection of a debt could reasonably pertain to a host of issues - including family or medical matters – which may be viewed by a consumer as much more pressing, than a debt owed.”
