Two plaintiffs claim in a proposed class action that millions of consumers are owed benefits they’ve already paid for after defendant GNC Holdings, Inc. unilaterally discontinued its popular Gold Card discount program in December 2016. The lawsuit claims that, in addition to causing consumer harm, the defendant violated California unfair competition laws. The lawsuit’s worst allegations, however, address GNC’s alleged conduct right up until it wiped out its Gold Card program:
“In December 2016, GNC unilaterally discontinued the program, resulting in [the plaintiffs]] and millions of other members of the class being unable to receive the benefits of the program for the full one-year period contemplated when they purchased their Gold Cards,” the lawsuit reads. “Remarkably, GNC continued to sell Gold Cards until just a few weeks prior to the discontinuation of the program, while having full knowledge that purchasers would not receive the benefit of the program.”
