A Florida woman has filed a proposed class action lawsuit against GC Services Limited Partnership claiming it implies that illegal fees can be applied to a debt.
A Florida woman has filed a proposed class action lawsuit against GC Services Limited Partnership claiming the debt collector misleads consumers by implying that interest and fees may be added to their static debts. According to the complaint, the plaintiff received three collection letters that stated the amount of her alleged debt and informed her that the balance may increase due to interest or other charges. The second and third letters, however, contained an amount that was exactly the same as the first, proving that the balance was actually not subject to extra fees, the suit claims. The plaintiff argues that the letters are misleading to the unsophisticated consumer because they fail to clearly and accurately disclose the amount of the recipients’ alleged debts.
