A proposed class action against GC Services Limited Partnership claims the company ran afoul of the Fair Debt Collection Practices Act (FDCPA) in a communication it sent to the plaintiff. Filed in New York, the lawsuit claims the defendant’s communication unlawfully failed to note whether the plaintiff’s balance owed could increase because of accrued interest and fees. Without this safe harbor language, the complaint argues, the unsophisticated consumer could be left uncertain as to the true amount of debt owed.
