A New York woman has filed a proposed class action lawsuit against GC Services Limited Partnership, claiming the debt collector neglected to clearly communicate.
A New York woman has filed a proposed class action lawsuit against GC Services Limited Partnership, claiming the debt collector neglected to clearly communicate in collection letters the amount of consumers’ alleged debts. The plaintiff supposedly received a letter from GC Services that contained a “balance due,” but lacked any mention of whether the balance would increase due to interest or fees. According to the complaint, the plaintiff could be led to believe that her account would be cleared by paying the full amount in the letter, but could also reasonably conclude that she would still owe undisclosed fees, such as interest, if she paid the “balance due.” The suit argues that the missing information leaves the letter open to more than one interpretation and renders it “deceptive” according to the Fair Debt Collection Practices Act. As a result, the plaintiff says she is left uncertain as to what actions she should take in response to the letter.
