GC Services Limited Partnership is the defendant in a proposed class action lawsuit that claims the debt collector failed to honor a consumer’s right to dispute an alleged debt. The plaintiff says he called GC Services and attempted to dispute his balance. The company’s employee supposedly offered to lower the balance by $100 instead of accepting the dispute, but the plaintiff refused and was transferred to an account manager, the suit says. The next employee demanded that the plaintiff provide a reason for his dispute, according to the complaint, which “wrongfully implied to [the plaintiff] that a dispute needs to be deemed valid in order for it to be considered a dispute.” The lawsuit further claims that the defendant unlawfully required the plaintiff to submit his dispute in writing instead of accepting it orally. The defendant’s requirements violate the Fair Debt Collection Practices Act and display an “utter disregard” for the plaintiff’s “absolute right” to dispute the debt, the complaint says.
