First Advantage Background Services, Corp. is the defendant in a proposed class action out of Arizona that alleges it violated the Fair Credit Reporting Act (FCRA). The plaintiff claims she applied for employment and that her prospective employer requested a credit report from the defendant. According to the complaint, First Advantage failed to notify the plaintiff that it was furnishing a report containing information about her. The suit further argues that the credit reporting agency sourced its data from a third party instead of directly from courthouses and therefore could not provide the most accurate and up-to-date information. On top of that, the plaintiff claims that the criminal record information reported by First Advantage was more than seven years old and was not permitted to be included in her report under the FCRA. As a result of the defendant’s purported violations, the plaintiff allegedly suffered a delay in the employment process and was ultimately terminated.
