Lawsuit Filed Over Alleged Cadillac SRX Sunroof Defects, Warranty Coverage

From California comes a proposed class action against Cadillac Automobile Company alleging certain sunroof seals and drains found in 2010-2013 model year SRX vehicles are defective. The 58-page complaint alleges the defect allows outside water to enter into the passenger compartment of the vehicles, which can lead to interior damage, mold growth, and damage to wiring, electronics, and the cars’ sound deadener.
Beyond the alleged defect itself, the lawsuit alleges Cadillac has denied warranty coverage to vehicles with the sunroof problem. The plaintiff claims that on newer SRX models (2014 and newer), the supposed defect has been corrected, yet Cadillac’s “bumper-to-bumper limited warranty” should cover class vehicle models since the warranty, on paper, is for “any vehicle defect related to materials or workmanship.”
“The express ‘Bumper-to-Bumper Limited Warranty’ offer by [the defendant] and its ‘Cadillac Shield’ warranty constitute contracts between [the defendant] and the consumers, including [the plaintiff] and the class members, who purchased or leased class vehicles,” the lawsuit argues. “Privity thus exists between [the plaintiff] and the class members on the one hand and [the defendant] on the other with respect to [the defendant’s] express warranties.”
Court documents allege Cadillac, in August 2013, sent a bulletin for technicians reportedly alerting them to customer complaints over alleged sunroof defects and possible fixes. To this point, the plaintiff argues Cadillac knew full well about possible sunroof defects during the warranty period covering proposed class members vehicles.
