A proposed class action alleges that Peerless Credit Services engaged in unlawful debt collection practices.
The case says the plaintiff acquired his debt through medical services received at St. Luke's Physician Group, which contracted with the defendant to collect money owed for the services. According to the suit, the plaintiff received a collection letter stating that the defendant charges a $3 convenience fee for credit card payments. The plaintiff alleges that this fee was an attempt to collect more money than he actually owes. As such, the case argues that the defendant violated the Fair Debt Collection Practices Act by attempting to collect from the plaintiff an additional amount of money “that was neither authorized by the agreement creating the debt nor permitted by law.”
The plaintiff seeks compensation for damages suffered as a result of the defendant's allegedly deceptive debt collection practices. The lawsuit also calls for the compensation of anyone in Pennsylvania who received similar collection letters in which the defendant imposed a convenience fee between one year before this action was filed and 21 days after.
