Lawsuit Filed Against Midland Credit Management Over Alleged TCPA Violations

A proposed class action has been filed against Midland Credit Management over a supposedly unsolicited call received by the plaintiff.

A proposed class action citing alleged violations of the Telephone Consumer Protection Act (TCPA) has been filed against Midland Credit Management, Inc. over a supposedly unsolicited call received by the plaintiff.
According to the suit, the defendant placed the prerecorded call to the plaintiff in September 2018 without first obtaining the woman’s express written consent. The lawsuit lists several complaints posted online about similar calls consumers have allegedly received from the defendant:
“Calls constantly even though [I] don[‘]t owe anybody.”
“Midland debt collector - collecting false debts[.]”
The case argues that the statements “represent just a small sampling of voluminous customer complaints regarding Midland’s practices and clear violations of the TCPA.”
