Loft Associates, LLC, which does business as Cheddar Express, is the defendant in a proposed class action lawsuit that claims the company sent unlawful text messages.
Loft Associates, LLC, which does business as Cheddar Express, is the defendant in a proposed class action lawsuit that claims the company sent text messages using an automated dialing system in violation of the Telephone Consumer Protection Act. The messages, according to the plaintiff, were sent without prior consent and were intended for a mass audience. The suit alleges that the texts were an invasion of privacy and a nuisance to consumers. According to the complaint, the texts read as follows:
“Your Business has been PRE-APPROVED for Capital Advance up to $250K. Please reply “CHEDDAR” or call 844-887-8082 to Get Funded. reply ‘STOP’ to opt-out.”
The proposed class includes anyone in the United States who received a text message like the plaintiff’s from the defendant that was delivered through an automated dialing system within the past four years.
