A California woman filed a lawsuit against defendant Equifax Information Services LLC that claims the credit reporting agency violated the Fair Credit Reporting Act in failing to accurately report the status of her alleged debt. The plaintiff says she filed for bankruptcy in 2013; as a result, her credit card debt was “discharged.” She claims that Equifax unlawfully continued to report her alleged debt as “Charged Off” instead of “Discharged in Bankruptcy”—a status that indicates she still owes her creditors. The plaintiff informed Equifax of the error, but it continued to include the “derogatory information” in her credit report during and after its purported investigation of the error, according to the complaint. The suit claims Equifax “willfully and negligently failed to comply with its duty to reasonably investigate,” resulting in damage to the plaintiff’s credit standing.
Equifax has been on the receiving end of similar disputes from thousands of consumers, but it “continues to employ inaccurate reporting procedures,” the lawsuit alleges. The complaint references several other lawsuits filed against Equifax, including a class action settled in 2008 that required Equifax to revise its processes. Despite these litigations, the company systematically harms consumers through its ongoing negligent reporting practices, the suit argues.
