Florida
Expand Incorporated (which does business as both Gigats and Softrock, Inc.) is facing a proposed class action lawsuit over allegations that it violated the Telephone Consumer Protection Act by sending unsolicited text message advertisements. The two plaintiffs, who both claim to have no business relationship with the defendant, say they each received at least three text messages from Gigats that were intended for other people.
The defendant allegedly operates a “job-matching program” that sends text messages to users about potential employment opportunities. The plaintiffs say they revoked their consent to receiving the texts, and claim it had never been given in the first place, by replying with the word “STOP.” Nevertheless, the defendant continued sending the unwanted messages, ignoring the plaintiffs’ requests to opt out, the suit says.
Even further, one of the plaintiffs says her number had been registered on the National Do Not Call Registry for at least 30 days prior to receiving the first text message.
