Everalbum, Inc. is on the receiving end of a proposed class action lawsuit that claims its photo-sharing phone application illegally sends automated text messages to users’ contacts. According to the complaint, when a consumer downloads the application, it requests access to his or her contacts list and proceeds to send text advertisements to all the numbers on the list, without the user’s prior knowledge. The texts are allegedly sent using an automated system without the recipients’ express consent, in purported violation of the Telephone Consumer Protection Act. The suit claims Everalbum’s unlawful practices have “resulted in the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals nationwide.”
