Enhanced Recovery Company, LLC has been named as the defendant in a proposed class action lawsuit alleging it violated the Fair Debt Collection Practices Act by sending a consumer a misleading collection letter. The plaintiff in the case, a New York resident, says he received a debt collection notice from the defendant that offered him a settlement and assured him that payment of the amount listed “will stop collection activity on this matter.” According to the case, this statement unlawfully overshadowed the consumer’s right to dispute the debt or request validation – actions the suit notes would also require the defendant to cease collection activities.
