Enhanced Recovery Company, LLC is facing a proposed class action filed by a West Virginia consumer who claims the defendant sent her a false and misleading debt collection letter. The notice allegedly informed the plaintiff that her “delinquent account may be reported to the national credit bureaus” when the statute of limitations for the debt in question had expired, prohibiting the defendant from filing a legal action against the plaintiff and reporting the debt to a credit reporting agency.
The suit argues that the defendant’s letter was misleading because it failed to inform the plaintiff that the age of her alleged debt barred the debt collector from taking the threatened actions against her.
