Enerson Law, LLC and CACH, LLC allegedly engaged in the practice of threatening legal action and filing debt collection lawsuits against Michigan residents over debts purportedly owed to SallieMae. Of the debts in question, a proposed class action lawsuit claims the companies “don’t own, have not been assigned, are not in the chain of title to prove ownership or have standing to sue upon.”
Filed by a Michigan consumer, the 17-page lawsuit claims the defendants’ practices violate the Fair Debt Collection Practices Act (FDPCA) and the Regulation of Michigan Collection Practices Act (RCPA).
