New York
A proposed class action has been filed against Einstein Noah Restaurant Group, Inc. over claims that its website is unlawfully inaccessible to visually impaired users. The defendant allegedly operates Einstein Bros Bagels shops and their corresponding website – www.einsteinbros.com – that, according to the suit, provides information about the stores’ locations and hours, menu items, and weekly specials, and allows users to purchase gift cards and food for catering. The plaintiff in the case, a blind New York resident, claims he attempted to access the website but was unable to interpret the content due to the site’s incompatibility with his screen-reading software. The suit alleges that the defendant has unlawfully neglected to implement readily available technology that would allow blind users to enjoy equal access to its site’s goods and services.
