Economic Recovery Consultants, Inc. is on the receiving end of a proposed class action lawsuit alleging the company sent an Arkansas consumer a misleading collection letter that failed to comply with the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the plaintiff received a letter from the debt collector regarding an obligation allegedly owed to Ouachita Co Medical Center. The notice supposedly directed the plaintiff to “address all future correspondence and payments concerning this account to the address below,” but then provided no address to which she could send a dispute or request other information about the debt, the suit alleges.
“Furthermore,” the complaint reads, “the only information given below that paragraph is the phone number for the collection department, implying that the dispute process can be done completely over the phone, which would significantly limit the consumer’s dispute rights.”
The case argues that the defendant’s letter misled the plaintiff and failed to adequately communicate her dispute rights under the FDCPA.
