Branded Restaurant Foods LLC is the defendant in a proposed class action that claims its websites discriminate against blind users by denying them full access to online goods and services. According to the suit, the websites – brandedrestaurants.com, dukesnyc.com, and bigdaddysnyc.com – are “heavily integrated” with the Duke’s and Big Daddy’s restaurants operated by the defendant, and offer users information about locations, hours of operation, delivery, menu options, contact details, and reservations. The plaintiff says he encountered various access barriers when attempting to navigate the sites with his screen reading technology, including lack of alternative text that describes content to the screen reader and empty or redundant links that result in unnecessary repetition. Once these access barriers are removed, the plaintiff says he intends to visit the sites and take advantage of their services.
