Five plaintiffs have filed suit against FCA US LLC (Fiat Chrysler Automobiles) and Cummins Inc. claiming the companies falsely advertised the diesel engines in certain Dodge Ram truck models and failed to fix an alleged defect once it was discovered.

According to the site, class members have been identified using FCA US’s purchase and ownership records and do not need to file a claim to receive payment from the settlement. Checks to eligible individuals will be mailed if and when the deal receives final approval from the court.

June 18, 2024 – Dodge Ram Engine Defect Lawsuit Settled for $6 Million
Automaker FCA US LLC and engine manufacturer Cummins Inc. have agreed to settle the proposed class action lawsuit detailed on this page.

The $6 million Dodge Ram engine defect settlement received preliminary approval from the court on June 7, 2024 and will cover nearly 34,000 vehicles nationwide.
Drivers eligible to participate in the deal include anyone who purchased or leased a new 2013, 2014 or 2015 Dodge Ram 2500 or 3500 truck with a Cummins diesel engine between November 26, 2014 and July 13, 2016 in Alabama, Colorado, Florida, Georgia, Idaho, Kentucky, Michigan, Mississippi, New Jersey, North Carolina, Ohio, Oklahoma, Pennsylvania, Utah, Virginia or Washington.
Court documents say that class members will receive a pro-rated share of the settlement fund, estimated to be $100.40 per covered vehicle. Class members do not need to submit a claim form and will automatically receive payments in the form of a check, which will be mailed to the driver addresses listed in purchase records provided by FCA US.
“These addresses will be updated using tools available to the Settlement Administrator, and copies of the Short Form Notice will be mailed to every Class Member at their most recent available address,” according to a memo submitted in support of preliminary settlement approval.
The memo says that checks should be distributed after the deal becomes effective. A final approval hearing is set for October 10, 2024.

Five plaintiffs have filed suit against FCA US LLC (Fiat Chrysler Automobiles) and Cummins Inc. claiming the companies falsely advertised the diesel engines in certain Dodge Ram truck models and failed to fix an alleged defect once it was discovered. The companies allegedly marketed the trucks as containing the “lowest emitting diesel engine ever produced” and claimed that it met federal and state emissions standards while delivering the same amount of power and fuel efficiency as earlier models. The plaintiffs argue, however, that the engines in these vehicles contain a defect that causes the emissions system to fail, requiring expensive repairs, loss of gas mileage, and reduced performance. In addition, the engines produce emissions that rise far above legal levels, the complaint claims. The plaintiffs argue that they never would have purchased the vehicles had they known the truth about the allegedly defective engines.
According to the suit, the defendants knew about the alleged defect since 2014, but continue to market the trucks as low-emission, high-performance vehicles. At the same time, the complaint says, the two companies have engaged in a “litigation battle” over which one of them is responsible for recalling the vehicles, thereby delaying the recall.
The suit seeks to cover a proposed nationwide class of people who, as of June 30, 2017, owned or leased a 2013–2017 Dodge Ram 2500 with Cummins Diesel (SCR systems, 2WD, 4WD) and/or a 2013–2017 Dodge Ram 3500 with Cummins Diesel (SCR systems, 2WD, 4WD). Subclasses have been proposed for residents of Alabama, Florida, Georgia, Michigan, and Pennsylvania.
